APOSENTO TERMS OF SERVICE AGREEMENT

Welcome to Aposento.com. The Aposento website, web application, and its associated services (collectively the “Service”) are owned and operated by Aposento ("we", "us", or "our"). This Terms of Service Agreement (“Agreement”) governs your rights and duties when using the Service.

Aposento reserves the right to modify, limit, change, or replace the Service or this Agreement at any time. It is your responsibility to review this Agreement regularly. Your continued use of the Service after any modifications constitutes your acceptance of those changes.

1. Service Description

Aposento provides a Software as a Service (SaaS) platform designed to help churches manage and track small group activity. Our Service allows for the input, storage, and analysis of church data to measure community engagement, leadership health, attendance, and offering metrics. The Service may also facilitate communication between church leaders and members via email or other digital means.

2. Warranties and Representations

By using the Service, you warrant and represent that:

• You are at least eighteen (18) years of age.
• You have the legal capacity to enter into this Agreement.
• You are a human individual (access via bots or automated scripts without permission is prohibited).
• You have the necessary permission to use and store the data of any individual you add to the Service.

Not HIPAA Compliant: You explicitly acknowledge that Aposento is not HIPAA compliant. You agree NOT to store sensitive Protected Health Information (PHI) subject to HIPAA regulations within the Service.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You are expressly prohibited from:

1. Spamming: Sending unsolicited bulk emails or messages.
2. Phishing: Attempting to obtain sensitive information.
3. Illegal Content: Posting content that promotes violence or illegal acts.
4. Malware: Distributing viruses or harmful code.

4. User Generated Content

You retain ownership of the data and content you submit to the Service ("User Content"). However, by submitting User Content, you grant Aposento a non-exclusive, worldwide, royalty-free license to use, host, store, and display such content for the purpose of providing and improving the Service.

5. Account Registration & Payments

To use the Service, you must register an account. You agree to provide accurate and current information. Payments are processed on a monthly cycle via Stripe, Inc. Fees are quoted in United States Dollars (USD).

6. Intellectual Property

The Service, including its code, design, logos, and architecture, is the exclusive property of Aposento. You are granted a limited, revocable license to use the Service for its intended purpose.

7. Termination

Aposento may terminate or suspend your access to the Service at any time, with or without cause. You may cancel your subscription at any time through your account settings.

8. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS". APOSENTO DISCLAIMS ALL WARRANTIES.

TO THE FULLEST EXTENT PERMITTED BY LAW, APOSENTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Dispute Resolution

This Agreement shall be governed by the laws of the State of California. Any dispute shall be resolved exclusively through binding arbitration conducted in Los Angeles, California.
